These Terms of Service ("Terms") govern your access to and use of the website cutburthcreations.com (the "Site") and any purchases of products or custom/commissioned work from Cutburth Creations ("we," "us," or "our").

Trading name: Cutburth Creations. Operated by: sole proprietorship / DBA “Nerdy Woodworker” (Nerdywoodworker.com). [formal legal entity TBD if later formed]

No separate LLC or Inc has been formed for Cutburth Creations, Homefield Fantasy, or Tech-Knowledge-E (TKE). Cutburth Creations is a separate brand / line of business from Homefield Fantasy and TKE. Homefield Fantasy is not Cutburth's contracting party.

By browsing the Site, creating an account, placing an order, or requesting custom work, you agree to these Terms. If you do not agree, do not use the Site or place an order.

1. Who we are (business)

Cutburth Creations sells handmade and catalog products and accepts commissions for custom work (including, without limitation, jewelry, millinery, crochet blankets, woodworking, engraving, 3D printing, and apparel) via the Site and related channels.

2. Eligibility

You must be able to form a binding contract under applicable law to place an order. Cutburth Creations is primarily for adults / general consumers — not a kids product. If you are under the age of majority in your jurisdiction, you may use the Site only with involvement of a parent or guardian. You represent that information you provide is accurate and complete.

3. Accounts

Some features may require an account. You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly at hello@cutburthcreations.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably suspect involve fraud or abuse.

4. Products & custom work

4.1 Product appearance

By shopping with us you agree that product colors, materials, and handmade finishes may vary slightly from photos or samples. Slight variation is inherent to handmade and small-batch goods and is not, by itself, a defect.

4.2 Custom work timelines

Custom work timelines are estimates until confirmed in a written quote (typically by email). Production schedules may change due to materials, complexity, or volume; we will communicate material delays when reasonably practicable.

4.3 Descriptions

We try to describe products accurately. If a material error in description, pricing, or availability affects your order, we may cancel or adjust the order as described in Section 6 and will notify you by email.

5. Pricing & payment

5.1 Prices

Prices are shown on the Site or in your written quote and are in the currency indicated at checkout or in the quote. Taxes and shipping (if any) are calculated as shown at checkout or as stated in your quote.

5.2 Payment processor

Card and other supported payments are processed by Stripe. We do not store full card numbers on our servers. Stripe's terms and privacy practices apply to payment processing. Cutburth's Stripe account is separate from Homefield Fantasy.

5.3 Authorization

By submitting payment, you authorize us (via Stripe) to charge the selected payment method for the order total, including applicable taxes and shipping.

5.4 Pricing errors

We reserve the right to cancel or refuse orders placed at an incorrect price due to typographical or system error, and to refund any amount already charged for a cancelled order.

6. Orders, shipping & returns

6.1 Offer to purchase

Placing an order constitutes an offer to purchase. We may accept or decline that offer. We may cancel orders for inventory limitations, pricing errors, suspected fraud, or other legitimate reasons, and will notify you by email.

6.2 Confirmation

An order confirmation email acknowledges receipt of your offer; it does not guarantee acceptance until we process and fulfill (or begin production on) the order, subject to these Terms.

6.3 Shipping & lead times

Shipping, lead times, free-shipping thresholds, and local pickup are governed by our Shipping Policy. Catalog items generally ship within the lead time listed on the product page after payment clears. Custom commission pieces ship after production per the timing confirmed in your quote.

6.4 Returns

Returns, exchanges, and refunds are governed by our Returns & Exchanges policy.

7. Intellectual property

7.1 Our IP

Designs, photos, text, logos, and other Site content belong to Cutburth Creations / the operator (or our licensors) unless otherwise noted. You may not reproduce, redistribute, or commercially exploit our designs, photos, or Site content without our prior written permission.

7.2 Custom commissions

Unless a written quote or separate agreement states otherwise: (a) we retain ownership of our underlying design methods, patterns, and pre-existing IP; (b) you receive the physical (or digital, if applicable) commissioned work you paid for; and (c) you must not reverse-engineer or commercially reproduce our designs without permission.

7.3 Customer-provided materials

If you supply text, logos, or artwork for a custom order, you represent that you have the rights to use them and that our use as instructed will not infringe third-party rights. You are responsible for clearance of customer-provided content.

8. Acceptable use

You agree not to: (a) use the Site for unlawful purposes; (b) attempt unauthorized access to our systems or other users' accounts; (c) interfere with Site security or operation; (d) scrape or harvest data in a manner that burdens the Site or violates law; (e) submit fraudulent orders or payment information; or (f) harass our team or other customers. We may refuse service or cancel orders that violate this section.

9. Analytics / tracking

10. Digital SKUs

11. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. EXCEPT FOR ANY EXPRESS WRITTEN WARRANTIES IN A QUOTE OR REQUIRED BY APPLICABLE LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Handmade variation and estimate-based custom timelines are described in Section 4 and do not constitute a failure of the product solely because of minor variation from photos or estimated dates.

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply only to the maximum extent permitted.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CUTBURTH CREATIONS, THE OPERATOR (DBA NERDY WOODWORKER), AND OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SITE, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO AN ORDER OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE ORDER GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law (including certain consumer protections, if they apply to you).

13. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Cutburth Creations and the operator from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of: (a) your misuse of the Site or products; (b) your breach of these Terms; or (c) customer-provided content or instructions that infringe third-party rights.

14. Governing law

WORKING ASSUMPTION (TBD — pending William confirm): These Terms are governed by the laws of the State of Kansas, U.S.A., without regard to conflict-of-law principles, except where mandatory consumer protection laws of your place of residence require otherwise.
